A marriage between two persons over the age of 18 creates a spousal relationship between the two persons. A spouse who is Canadian Citizen or Permanent Resident is qualified to sponsor his wife or husband if they are outside of Canada provided the marriage is both legal in Canada and in the country in which the marriage occurs.
However, if the spouse has a child(ren) from previous marriage, provided the child(ren) is under the age of 22. A marriage is not considered legal in Canada if one of the spouse is under age 18, even though that marriage is legal outside of Canada
Same Sex marriage is legal in Canada. A spousal relationship exists when two same sex couple got married. The marriage also has to be legal in that country to qualified as a legitimate marriage if the marriage is outside of Canada. If the Same Sex marriage is not legal in the home country, then the marriage is considered not legal in Canada for immigration purposes. However, a certificate of marriage needs to be provided for a certain date.
Conjugal Partner is defined when a couple who has engaged in a BINDING relationship for at least 12 months. Usually one partner is outside of Canada and who can not be reunited as a couple because of unforeseen circumstances beyond their control. Common Law Partner is defined in Section 1 of the IRPR as two persons in a relationship, an individual who is cohabiting with another person in a conjugal relationship, having so cohabited for a period of at least 12 months. The twelve months period has to be CONTINUOUS. I.e no breaks in between the 12 months period. But there are exceptions.
